Masaryk University's actions are contrary to the fundamental principles of due process and the presumption of innocence
Statement by Prof. Ivan Foletti on his suspension and dismissal from MUNI Faculty of Arts
Masaryk University first suspended me and then dismissed me on the basis of an internal investigation, which I consider to be non-transparent and procedurally flawed. The university did not provide me with all the specific charges in full and prevented me from fully defending myself. I did not have the opportunity to familiarize myself with all the allegations against me or to respond to them adequately.
According to available information, the final report received by the dean from the ombudswoman was approximately five times more comprehensive than the document provided to me. Such a procedure creates obvious inequality between the parties. If one party is allowed to make decisions based on complete information and the other is denied a substantial part of it, it cannot be considered a fair process.
The termination of employment is based on vague and generally formulated allegations of "violating the psychological safety of students" without the facts of the violation of my work duties being transparently and specifically defined and documented. On the basis of such vague formulations, the most serious labor law intervention was taken. Such an approach is disproportionate, unconvincing, and difficult to defend in a legal review.
The suspension was presented to the public as a protective measure. In reality, it was a fundamental interference in my professional activities without clear and specific justification. During my tenure, I have never received a formal reprimand indicating a serious breach of my work duties. Nevertheless, the most serious labor law measure was chosen – termination of employment. In recent years, I have been repeatedly recognized by the university and state institutions for my teaching and research achievements.
I reject the conclusions that have been attributed to me. I consider my dismissal from FF MU to be invalid and I am convinced that such a procedure will not stand up to legal review.
This is not just my personal case. If an academic can be deprived of their position without the full opportunity to defend themselves and without transparently proven facts, it undermines confidence in the entire university.
